Terms and Conditions of hire

1. Equipment Provided: Contractor hereby agrees to provide the sound equipment specified overleaf (as part of this agreement), along with all personnel required for its operation. Contractor warrants that the equipment listed is in good working order.

2. Location: Contractor shall have the equipment provided set up and ready to operate at:

3. Load-in: Load-in may commence at ____am/pm ____/____/20__

4. Soundcheck: Soundcheck may commence at ____am/pm ____/____/20__

5. Show start time: Showtime is ____am/pm ____/____/20__

6. Show ending time: Contractor shall operate and leave the equipment set up until ____am/pm ____/____/20__

7. Deposit/Payment: Buyer shall pay to Contractor the amount of £100 upon the execution of this agreement as a non-refundable fee for the Contractor’s services. At the completion of sound check, Buyer shall pay to Contractor the balance as detailed overleaf. Overtime shall be due and payable anytime the Show ending time differs from that agreed in no.6 above by a period greater than 30 minutes. Overtime compensation shall be computed at a rate of £50 per hour or part thereof.

8. Personnel: Contractor shall provide personnel to operate all equipment provided for this agreement. No other personnel, including Buyer and/or their employees, shall operate the Contractor’s equipment without the express written permission of the Contractor. No person (except those with explicit permission or working on behalf of Robert Nisbet) may move, operate or otherwise interfere with any equipment supplied. For ‘Dry-Hire’ equipment, only the hirer is thus authorised.

9. Security: Buyer shall provide adequate security to protect the Contractor’s equipment and personnel during the term of this agreement. Buyer shall also provide security personnel at access door during load-in/load-out, and at main mixing console for the entire time members of the public are admitted to the venue.

10. Theft or damage to equipment: Buyer shall be responsible for any theft or damage to Contractor’s equipment while located at the Venue except for normal usage unless such theft or damage was caused by an act or omission of contractor. This responsibility begins when equipment transportation is unlocked at load-in, and ends when transportation is locked at load-out. Equipment shall be valued at current replacement value. Reimbursement for damages shall be made within a seven-day period from the date of the damage.

11. Access Permits: Buyer shall issue “Access All Areas” permits to all personnel of the Contractor in advance of Contractor’s arrival at the Venue.

12. Electrical Power: Buyer shall provide safe power installed by registered electricians to the requirements specified.

13. Venue Set Up: Buyer shall have the venue (including stage) set up completed 30 minutes before the Load-In time specified herein.

14. Parking: Buyer will provide adequate parking (as specified) immediately adjacent to the load-in/load-out area, and parking/access permits shall be issued in advance or the Contractor’s arrival. Parking shall be reserved in advance for any vehicle the Contractor may need in the performance of his duties.

15. Independent Contractor Status: Contractor is acting as an independent contractor in the performance of his duties herein.

16. Subcontractors: Subcontractors shall perform their duties as if directly employed by Robert Nisbet, and shall be bound by the same agreement.

17. Weather: Contractor or Buyer have the right to interrupt the performance of Contractors duties due to inclement weather or and other conditions that the Contractor or Buyer reasonably regard as hazardous to and person or that would damage Contractor’s equipment.

Contractor will not be required to perform in wet conditions, conditions of high wind, or any other severe weather conditions. It is agreed that Contractor is the only one authorized to make any weather determinations and both parties agree that Contractor is qualified to make weather determinations.

If a heavy rain begins, operations stop IMMEDIATELY and all equipment gets covered up. Power is shut down IMMEDIATELY. AT ANY SIGN OF LIGHTNING, POWER IS SHUT DOWN.

Furthermore, if it is determined the weather is too bad to perform the contract, Contractor will be paid in total for the show.

18. Safety: Contractors working on behalf of Robert Nisbet reserve the right to discontinue supplying any service in the event that they feel their safety has been compromised or that the equipment in use may get damaged.

19. Severability: Should any portion of this agreement prove to be invalid, illegal or unenforceable, it shall not affect the balance of this agreement.

20. Insurance: Contractor shall obtain and keep in force, at its sole cost and expense, public liability insurance for the duration of this agreement.
